1. What NextStep Lex is — and what it is not
NextStep Lex provides a software-as-a-service platform that assists licensed immigration attorneys and law firms with tasks such as client intake, USCIS form preparation, supporting-document collection, package assembly, and client communication. The Services are a tool used by attorneys in the ordinary course of their practice.
NextStep Lex does not:
- Practice law or provide legal services.
- Provide immigration advice, opinions, strategy, or recommendations about any specific case or set of facts.
- Represent any client before USCIS, EOIR, or any court or agency.
- File anything with USCIS or any other government agency.
- Act as a substitute for a licensed attorney.
Any suggestion, validation flag, source citation, template, or automated output produced by the platform is informational only and is provided to assist an attorney’s independent professional judgment. It is not a legal opinion and must not be relied on as one. The attorney using the platform remains solely responsible for the accuracy, completeness, legality, and strategic soundness of every filing.
2. No attorney-client relationship
Your use of the Services, submission of information through the waitlist or contact forms, receipt of marketing communications, or interaction with our staff does not create an attorney-client relationship between you and NextStep Lex or any of its personnel. We do not accept clients, and we cannot represent you.
3. You must consult a licensed attorney
Immigration law is complex, jurisdiction-specific, and changes frequently. Even small errors in facts, forms, or supporting documents can have serious consequences — including delay, denial, removal, or permanent bars. If you are a client, applicant, beneficiary, petitioner, sponsor, or family member evaluating your options, you must consult a licensed immigration attorney in the relevant jurisdiction before taking action on any immigration matter. Do not rely on information from the Services in place of that advice.
4. Eligibility and account use
The Services are intended for use by licensed attorneys, law firms, and the professional staff and clients they authorize to access their workspace. You must be at least 18 years old and legally able to enter into a contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at admin@nextsteplex.com of any suspected unauthorized use.
5. Attorney responsibilities
If you are an attorney or law firm using the Services, you represent and warrant that:
- You are duly licensed to practice law in the jurisdiction in which you provide legal services, and your license is in good standing.
- You will use the Services only in a manner consistent with your professional and ethical obligations, including the rules of professional conduct that apply to your practice.
- You are solely responsible for the legal analysis, strategic judgment, and final review of every matter processed through the Services, and for the accuracy and legality of every filing submitted to any government agency.
- You will supervise all use of the Services by staff, clients, and any other authorized users of your workspace, and you are responsible for their actions.
- You have obtained all consents and authorizations required to upload, process, and store information about your clients and any third parties in the platform.
6. Acceptable use
You agree not to:
- Use the Services to engage in the unauthorized practice of law in any jurisdiction.
- Hold yourself out as an attorney, immigration consultant, or representative if you are not lawfully authorized to do so.
- Reverse engineer, decompile, scrape, or otherwise attempt to derive the source code or underlying data of the Services.
- Upload malicious code, attempt to interfere with the availability of the Services, or bypass any security or access control.
- Use the Services in violation of any applicable law, regulation, court order, or third-party right.
7. Content and ownership
The Services, including all software, design, text, graphics, and underlying rules and validation logic, are owned by NextStep Lex and its licensors and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms and any applicable subscription agreement.
You retain ownership of the information you and your authorized users enter into the platform. You grant NextStep Lex the right to host, process, and display that information solely to operate and improve the Services for you, and to comply with law.
8. Third-party information
The Services may reference or link to third-party materials, including USCIS forms, instructions, statutes, regulations, and policy manuals. Those materials are owned by their respective rights holders. We provide references and citations to help attorneys locate primary sources; we do not warrant that any third-party material is current, complete, or applicable to any particular matter.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, NEXTSTEP LEX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY OUTPUT WILL BE ACCURATE OR APPROPRIATE FOR ANY PARTICULAR CASE, OR THAT ANY VALIDATION FLAG, SOURCE CITATION, OR TEMPLATE IS CURRENT OR CORRECT. NOTHING PRODUCED BY THE SERVICES IS LEGAL ADVICE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTSTEP LEX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES — INCLUDING WITHOUT LIMITATION ANY LEGAL OR IMMIGRATION OUTCOME OR CONSEQUENCE. IN NO EVENT WILL NEXTSTEP LEX’S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO NEXTSTEP LEX FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You will defend, indemnify, and hold harmless NextStep Lex and its officers, directors, employees, and agents from and against any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or relating to (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; (d) any claim that your use of the Services constituted the practice of law or provision of immigration advice by NextStep Lex; or (e) any immigration or legal outcome or filing based in whole or in part on information from the Services.
12. Termination
We may suspend or terminate your access to the Services at any time for any reason, including for violation of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including Sections 7 (Content and Ownership), 8 (Third-party Information), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law).
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a revised “Last updated” date. Continued use of the Services after a change becomes effective constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
