I-864 domicile evidence: what USCIS expects a sponsor to show
USCIS Policy Manual Volume 6 lays out how a sponsor demonstrates US domicile for Form I-864. Here's the checklist your evidence section should hit before you file.
What changed
USCIS Policy Manual Volume 6, Part B covers Form I-864 requirements including the domicile test. The guidance is unchanged in structure — what changes case-to-case is which evidence category a particular sponsor fits into.
A sponsor living abroad can still qualify by showing concrete steps to resume US domicile (a lease, a job acceptance, children enrolled in US schools). The evidence section carries the weight.
Who it affects
Every I-864 sponsor on a family-based filing — immediate relative and family preference categories alike.
Joint sponsors and household-member sponsors (I-864A) face the same domicile standard where applicable.
What to do
Run every open I-864 matter through the domicile checklist: tax returns filed as a US resident, US address of record, US employment, voter registration, or — for sponsors abroad — a dated plan to return.
If the sponsor is abroad, attach the reestablishment evidence in the same exhibit as the I-864 so the officer sees both together.
