I-130 filing fee rules: what the current USCIS schedule says

A refresher on how USCIS prices Form I-130 for family-based petitions, how exemptions are determined, and where to confirm the fee each time you file.

What changed

USCIS publishes the current I-130 filing fee on the official I-130 page, together with any applicable biometric or supplemental fees. Firms should treat that page as authoritative and cross-check at the time of filing rather than relying on a cached figure.

Fee updates generally take effect on dates USCIS announces in advance. The direct form page is where the active amount, effective date, and transitional guidance are posted.

Who it affects

Any attorney filing a Form I-130 — including spouse (IR-1/CR-1), parent (IR-5), unmarried child (IR-2), and all family-preference categories (F1, F2A, F2B, F3, F4).

Separately-filed I-130A (spouse supplement) does not carry its own filing fee and is attached to the I-130 package.

What to do

Before preparing a payment or invoice, open the official USCIS I-130 fees section and confirm the current amount.

Flag any petition sitting in draft status near a fee transition date — USCIS will accept the fee that matched the postmark/receipt date rules in effect for that filing.
